In New York, you can definitely file a claim for a hit-and-run accident. And unfortunately, they’re more common than most people think. These hit-and-run accidents are first typically investigated by the police, and we will, of course, bring in the police if they are unaware of it. We will even send out our own private investigators. If possible, it’s really important to determine who the driver was in the hit-and-run accident. And sometimes that can be done through video surveillance, through witnesses.

And then after we try to figure out who that was, it’s important to figure out who owned the car. Cuz often times the person driving the car in the hit and run has fled the scene because they stole the car. And we have to make a determination. Was this car actually stolen or did they have permission to drive the car? Cuz that can affect insurance coverage.

Really, at the end of the day, you can still have a claim for personal injury in a hit-and-run case, whether it’s from the owner of the car who hit you or even sometimes looking at your own insurance policy that can protect you if we can’t figure out who that car is or if they don’t have insurance coverage.
