Who is liable in a slip and fall case?
In a slip and fall case, the liable party is most often the property owner. In New York State, the responsibility for keeping property safe generally rests with the owner.
There are situations where a property owner may attempt to shift responsibility to a third party, such as a property management company or maintenance contractor. However, that is not common. When it does occur, we conduct a thorough investigation to determine who truly had the duty to maintain the property and whether that duty was properly fulfilled.
