Who Is Liable in a Motorcycle Accident Case?
In a motorcycle accident case, we have to first prove liability before we even get to assessing the damages that our clients have suffered. And really what we’re looking at is negligence. You know, was the motorcycle rider, our client negligent at all? And it’s our job to prove that he or she wasn’t. It’s our job to prove that the other driver or drivers involved, of course, owed our client on the motorcycle at duty of care, they then violated that duty by not being careful or being reckless. And as a direct result, they caused serious injury to our client. And there’s a lot that goes into proving liability. Again, there’s a huge investigation, there’s talking to witnesses, there’s collecting data from the bike and, and from the car. But it’s really, really imperative to prove that it was the other car or the other driver’s responsibility. So the insurance company doesn’t try to put liability on our client who is riding the motorcycle.
