Can You Sue After a Construction Accident While on Workers’ Comp?
If you’ve been injured on a construction site, you really do need to consult with an attorney right away. The reason for that is there are varying time limits for when you need to file a lawsuit.
If your construction project involved only private entities and you’re hurt on that site, you have three years from the time you were injured to bring a lawsuit against the liable parties. However, as we frequently see, construction sites often involve municipal or state entities. Sometimes it’s a municipality or the state that owns the property or has contracted for the project.
In those cases, the timeline shortens dramatically. For municipalities, an individual only has one year and 90 days to bring their case. In fact, they must take steps within the first 90 days to protect their ability to sue. That’s why it’s critical to speak to an attorney right away, so they can begin investigating, determine who the liable parties are, and figure out exactly what your time limits are going to be.
