On December 26, 2024, the tortfeasor pulled out of parking lot directly into the right-of-way path of our client, injuring his lower back. Dustin was already dealing with significant lower back problems for a period of years but this collision exacerbated his symptoms to unbearable levels. An MRI demonstrated significant vertebral disc extrusions at two levels of his lumber spine which were compressing the nerve roots. In April 2025 he underwent a single-level laminectomy and discectomy to reduce the extruded disc and alleviate the nerves. We successfully pled his case that although he had extensive pre-existing degradation and symptomology in his lumbar spine he was still functioning and able to maintain employment, and that the subject collision caused just enough additional injury to result in a tipping point towards significant disability.
