Liability for Suffolk County Pedestrian Accidents
Pedestrians have a naturally small profile, and they’re more likely to be overlooked by drivers. Drivers must use caution and slow down when necessary to avoid colliding with them. According to NY Veh & Traf L § 1180, “No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing.” It is common for several factors besides speeding to contribute to pedestrian accidents.
- Heavy Traffic: Heavy traffic can make it more difficult to spot pedestrians in the roadway.
- Reduced Visibility: Pedestrian accidents tend to happen at night and during times of reduced visibility.
- Driver Intoxication: Drivers are substantially more likely to hit pedestrians if they’re intoxicated. What many drivers do not realize is that a variety of substances besides alcohol may impair their ability to drive safely.
- Distracted Driving: Many accidents involve a driver that is distracted by their cell phone. Another common issue is that drivers may be reaching for an object and briefly take their eyes off the road.
Even if a pedestrian is in the middle of the road, this does not relieve a driver of their duty of care to slow down and use caution to avoid hitting a pedestrian. When a driver fails to slow down to avoid hitting a pedestrian in the roadway, this could form the basis of a negligence claim. Negligence is the failure to operate with the care necessary to safeguard the well-being of others. Depending on the facts of any case, there could be several liable parties for a pedestrian accident, particularly if more than one vehicle was involved.
Common Injuries Associated With Pedestrian Accidents
Pedestrians lack the protection afforded by enclosed vehicles and are more likely to be seriously injured or killed in the event of a crash. Injury severity tends to increase with speed. According to the AAA Foundation for Traffic Safety, “Results show that the average risk of severe injury for a pedestrian struck by a vehicle reaches 10% at an impact speed of 16 mph, 25% at 23 mph, 50% at 31 mph, 75% at 39 mph, and 90% at 46 mph.” Victims of pedestrian accidents tend to suffer very serious injuries.
- Head Injuries: If a pedestrian is knocked to the ground, they could easily sustain a major head trauma.
- Spinal Cord Injuries: Another common injury sustained in pedestrian accidents is spinal cord trauma. This includes broken vertebrae that can impair a person’s ability to walk.
- Broken Bones: Many pedestrians sustain broken bones and complex fractures, particularly in their legs and arms.
- Organ Damage: Not all of the injuries associated with pedestrian accidents will be outwardly obvious. Victims routinely sustained major damage to their internal organs.
It is important that evidence be gathered and analyzed after any pedestrian collision. The evidence can help reveal what parties may be liable. If a driver is negligent and kills a pedestrian. They can be held personally responsible through a civil action. This right extends to the family members of any victim who dies in a pedestrian crash. They are able to seek some measure of accountability through a wrongful death claim.
