What is the statute of limitations for dog bite cases involving children?

When a child is bit by a dog in New York State, the statute of limitations for that child is three years after the child’s 18th birthday. Ordinarily, the statute is three years from the time of the bite. That would be the case for an adult.

In the case of a child, the parents may decide they want to pursue the claim on the child’s behalf before the child’s 18th birthday. But in the event they decide not to, want to leave it up to the child, or are simply unable to, the child’s statute of limitations is three years past his or her 18th birthday.
