Why Is It Difficult To Determine Average Settlement Amounts in Personal Injury Cases?

It’s very common for clients to ask us, “How much is my case worth?” And that’s a valid question, but it’s very difficult to answer that question, especially early on in a case. And that’s because personal injury settlements are all unique based on a lot of different factors and can be quite complex. So, the first thing we’re always looking at and trying to determine the value of somebody’s case, of course, are our client’s injuries. How has this affected them already? How is this going to affect them in the future?

How much is it going to cost to provide them with the medical care that they’re going to need? But then kind of in the background of all of that, what’s really extremely important is how much insurance coverage is available. Because oftentimes people are injured in say a car accident, but the defendant driver only has $25,000 available in coverage. And if there’s no additional available coverage, that means regardless of how serious your injuries are, the case can only be worth $25,000. But every case is completely different.

There’s so many factors. Again, it’s how’s this affected you? How’s it affected your family? Did you lose your job or are you unable to work in the same capacity you used to? You know, what are the nature of your injuries? Are you going to have surgery or how many? Do you need to be compensated for future medical care? There’s a lot of different factors at play and one of the largest ones again is the amount of insurance available. So these are complex. It’s natural for a client to ask us that. But as we gain more information and learn more, we’ll continue to update our clients with how much we believe their case is worth.
