Is New York a No-Fault State?

If you’re injured in a car accident in New York, it’s important to remember that New York is a no-fault state. And really what that means is, is that regardless of who’s at fault for the accident, the insurance policy covering the car that you were injured in is going to pay for certain things. Meaning, it’s going to pay for your medical bills related to injuries from the accident. It’s going to pay in some instances for your loss economics, meaning your lost wages, up to a certain amount. Sometimes it can pay for some other things and you can even be reimbursed for your mileage. But even if you’re not at fault, so even if you were rear-ended or you were T-boned, your insurance policy or the insurance policy covering the car you were in is going to be the one that pays for those things that I outlined.
