Liability for Holtsville DUI Car Accidents

It is illegal for any driver in New York to operate their vehicle under the influence of alcohol or drugs. According to NY Vehicle and Traffic Law § 1192, “No person shall operate a motor vehicle while the person’s ability to operate such motor vehicle is impaired by the consumption of alcohol.” There are many ways that even small amounts of alcohol can impair a person’s ability to operate a vehicle safely.

  • Visual Function: Alcohol can cause a serious decline in a person’s ability to track moving objects.
  • Coordination: Alcohol can cause a reduction in a person’s muscle coordination. This can lead to delayed reactions in the event of imminent danger.
  • Concentration: Alcohol can cause substantial impairment in terms of a person’s ability to concentrate while driving.

If a driver hits a pedestrian while under the influence of alcohol, this could serve as evidence of negligence. There is a presumption of negligence on the part of a driver who departs from their own lane of traffic and hits another vehicle or pedestrian. Depending on the facts of any case, there could be multiple liable parties for a pedestrian accident. This includes any driver responsible for a crash. It could also include a construction company or public employer responsible for maintaining a worksite by the side of the road.

Preventing New York Roadway Accidents

Motor vehicle collisions remain a leading cause of preventable injury and death for workers. According to the Centers for Disease Control, “Millions of workers drive or ride in a motor vehicle as part of their jobs. And, motor vehicle crashes are the leading cause of work-related deaths in the U.S. The type of company or job doesn’t matter — the risk is there.” Employers should take several measures to protect workers from the hazards posed by motor vehicles.

  • Traffic Control: Employers must create traffic control zones to separate workers from other vehicles that are traveling nearby.
  • Visibility: Employers must provide their workers with high-visibility clothing to reduce the odds that they will not be seen by drivers.
  • Spotters: Employers should use spotters or flaggers to direct traffic away from work zones.
  • Barriers: Employers should typically erect barriers or position vehicles to create a buffer zone between traffic and workers.

Car accidents and work zones tend to be highly preventable. The victims of these collisions may suffer serious injuries that impair their ability to work. They may also be burdened with high medical bills. Any person injured in a workplace accident may be able. To pursue damages through a civil claim. Damage can help cover many of the losses commonly associated with an accident.
