Liability for Mount Pleasant Car Accidents

Drivers have a legal obligation to exercise due care to avoid colliding with other vehicles on the roadway. Pursuant to NY Veh & Traf L § 1120, drivers must operate their vehicle on the right side of the roadway at all times, except in a very limited range of circumstances. There is a presumption of negligence on the part of any driver that enters into opposing lanes of traffic and collides with a vehicle head-on. These types of accidents can happen for a variety of different reasons.

  • Intoxication: A large portion of wrong way collisions involved intoxicated drivers. What many drivers do not realize is that there are a variety of substances besides alcohol that could impair their ability to drive safely. This includes over-the-counter medications.
  • Fatigue: Another major cause of motor vehicle collisions is fatigue. In fact, the Centers for Disease Control estimates that staying awake for only 17 hours can reduce a person’s ability to operate safely equal to driving with a BAC of 0.05%.
  • Distraction: In the modern era, drivers face a variety of distractions that could potentially cause a head-on collision. In particular, many drivers crossed into opposing lanes of traffic while staring at their cell phones.
  • Speed: Speeding can easily cause a driver to lose control and cross into opposing lanes of traffic. For example, a driver could lose control as they are rounding a curve in the roadway.

If a driver crosses into opposing lanes of traffic and hits another vehicle head-on, they could face civil liability for the collision. Depending on the facts of any case, there could be several liable parties for a head-on collision aside from any driver. The details really matter. Among other things, the company that manufactured the parts on a vehicle could bear some liability for a crash if a vehicle system failure caused a driver to lose control. Not every head-on collision is entirely the result of driver negligence.

Steps to Take After Mount Pleasant Head-On Car Accidents

Motor vehicle collisions remain a major cause of preventable injury and death across New York. According to the New York Department of Health, “On average there were 6,207 hospitalizations due to motor vehicle traffic-related injuries among vehicle occupants, hospitalizing 31.6 of every 100,000 New Yorkers. The rates were highest for males and New Yorkers ages 20-24 followed by New Yorkers ages 65 and older.” It is essential that certain steps are taken after any car accidents.

  • Police Report: The police report created after the collision should be sought. This report can help reveal what factors may have contributed to a crash. It represents an officer’s initial impression of what happened and who could be liable.
  • Accident Reconstruction: In certain situations, investigators may rely upon accident reconstruction to determine how a collision took place. Accident reconstruction uses math and physics to help answer critical questions related to how a crash likely took place.
  • Medical Records: All of the medical records and autopsy reports related to the collision should be collected. They are an important piece of evidence and can be useful in a variety of different ways.
  • Independent Review: The family of any person who died in a car accident involving a police officer should seek an independent review of the collision with a legal team experienced in tort claims. This team can investigate the unique facts of the case free of cost and help identify all potentially liable parties.

Wrong-way car accidents represent a relatively small number of the total motor vehicle collisions that take place. But they are disproportionately involved in serious injury and fatal collisions. These types of accidents are nearly always preventable. They tend to involve situations where drivers were violating one or more traffic regulations. Unfortunately, police officers and their insurance providers will virtually never accept responsibility if they cause a collision. This is why it is so important that these incidents are thoroughly investigated by an outside party.
