What Is the Personal Injury Claim Process?

A big question we get asked all the time is what can I expect in my personal injury claim or what is the process? The real answer is it it really depends on each case ’cause no two cases are the same even though they may have some similarities. But there’s two kind of bigger ways you can think about personal injury cases. Every case begins with an investigation. A thorough investigation into what happened, interviewing witnesses, sending out investigators to the scene, collecting all the evidence we possibly can so we can make a determination on the likelihood of success in the case. While that’s going on, we take great pride in setting up our clients with the best doctors so they can get the best care by people in the community who understand how to treat injuries sustained from these types of accidents depending on what happened to this person. But after we get through the investigation and treatment, there’s kind of two ways that cases can go. Often times, because of the nature of somebody’s injuries, because of the nature of the liability, and compared to the insurance policy available, sometimes we can get our clients the best settlement possible or the most money under the insurance policy without ever filing a lawsuit. Other times we do have to file a lawsuit or at least we will recommend to our clients who get to make the decision that we should file a lawsuit. That starts the litigation process. In litigation, you know, that obviously can take a lot more time, but we’re in litigation because we’re fighting to get our clients the most money possible. And the insurance companies would not do the right thing unless we file this lawsuit. There’s many stages to litigation. Sometimes it’s rare, but sometimes they end up in trial. But really, whether it’s a pre-lawsuit path or a litigation or lawsuit path, we keep our clients updated every step of the way. And really, they are making the decisions based on our advice and everything that we’re presenting to them. Again, we’re designed to get them the most money possible. But if our clients at any point in time say, “Hey, I don’t want to go any further. I’ll accept what’s available now.” We just want to make them happy. And we’ll do that.
