If I’m hurt on the job, does that impact the statute of limitations?
If you’re hurt on a job in New York, there’s going to be a statute of limitations that applies to your case. So, there’s going to be one set of statute of limitations that applies to your workers’ compensation case. And then there’s going to be the statute of limitations that applies to your personal injury case. And in the personal injury case, it’s typically 3 years from the date of your accident, uh, whether you’re at work or not. But like any other personal injury case, if the property owner bears responsibility and they are a municipal defendant, so you’re working on a state, a county, a a city job site, there’s a much shorter statute of limitations. It’s one year of 90 days. And then and there’s a 90-day notice of claim requirement. So you have to really look out for those. And if you’re injured on a job, you have to remember there could be again both the workers comp component and the third party personal injury case.
