How is negligence determined in pedestrian accidents?

There’s a number of things considered when determining negligence in a pedestrian accident. So, the first thing we’re always looking at is like where did this accident occur? Where was the pedestrian in relation to the car? And we really need to break down first and foremost what was this driver doing or not doing when they injured our client. And we’re always looking for things like were they driving while distracted? Did they blow through a light? Did they fail to sort of give the right away to the pedestrian? Was the pedestrian in a crosswalk? Did they have the white walking sign or were they not supposed to be crossing? If they were in a parking lot, we want to look at where this person was in relation to the car that hit them.

There’s a lot of different things that we’re looking at, but again, this is why it’s important to call a firm like ours right away. Just because you were hit as a pedestrian does not mean that the insurance company is not going to try to put blame on you. They are going to as much as they possibly can.
