What Factors Impact the Settlement Amount in Pedestrian Accident Cases?
Settlement amounts in pedestrian accident cases are typically affected by two main things. One, the amount of insurance that’s available. And most people don’t understand that the car that hits you, that insurance policy, right, the max that’s there, is probably the max you’re gonna get, ’cause most people aren’t running around with big bank accounts full of money. It’s, it’s really just the insurance that you’re going after. So that dictates it. Number two, it’s the serious nature or how serious the injury is, and especially in comparison to the amount of insurance that’s available. And number three, I would say too, is liability. Because there are some situations where pedestrians are partially at fault, but again, your portion of fault will just diminish by that percentage, you know how much you can recover in that case. And we take on those cases all the time. So I think the, those are really the main three factors that really affect settlements in pedestrian accident cases.
