A client called on behalf of their family member who was a resident in an assisted living facility in Williamsville, NY. Their family member was legally blind, and a known fall risk. Our client had proof that the call bell was not being answered in a timely fashion, and eventually, their family member fell and fractured her sacrum, which resulted in a sever limitation in her mobility for the last year of her life. Our client’s family member was 94, so proving the loss of mobility and independence due to these injuiries was tricky. We spoke with our client on a regular basis and kept him updated. In this instance, Michaelangelo also approached the defense attorney about an early resolution given the circumstances of the case. Negligence was clear and the family member’s documentation helped this case. In the end we were able to recover $150,000 for our client and their family member.
