VIRGIL, NEW YORK (January 11, 2026) – A truck driver identified as Flavio Pacheco was injured in a Virgil semi-truck accident on Interstate 81 by Mile Marker 42.6.
Cortland County officials are saying that the accident took place around 6:48 AM on December 23. According to the New York State Police, a 23-year-old truck driver from Brooklyn was traveling too fast for the snowy conditions on the roadway.
That driver lost control of their vehicle and jackknifed in the middle of the roadway before being involved with a second semi-truck driven by Flavio Pacheco. Paramedics were called to the scene of the collision to help the victim.
Flavio Pacheco was transported to Guthrie Cortland Medical Center after he told first responders he was experiencing back pain. Photos of the accident site show the road covered in snow.
A full investigation into the Virgil truck accident remains ongoing at this time.
Liability for Virgil Semi-Truck Accidents
Truck drivers are required to obtain a commercial driver’s license and are expected to operate with an abundance of caution to avoid collisions. All truck drivers in New York have a legal obligation to maintain their vehicle at a safe speed. Pursuant to NY Vehicle and Traffic Law § 1180, “No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing.” There are many reasons that a truck driver may need to slow down below the speed limit.
- Poor Weather Conditions: Truck drivers should slow down substantially during periods of inclement weather. Snow in the roadway can dramatically increase the time it takes for a truck to stop safely.
- Slick Roadways: Even if the weather outside seems all right, truck drivers should slow down if the roads are slick after it has rained.
- Heavy Traffic: It can be dangerous for a truck to travel the speed limit during periods of heavy traffic. Many truck accidents occur when truck drivers fail to properly slow down during traffic jams.
- Roadway Decline: Traveling at normal freeway speeds on a roadway decline can lead to a catastrophic accident. Among other things, it increases the likelihood that the brakes on a truck may fail.
When a truck driver is injured in a collision on New York roadways, they may have legal recourse through the workers’ compensation system if they were operating as an employee. This is a no-fault insurance scheme designed to help injured workers. Victims may also be able to pursue damages through a third-party liability claim if an entity separate from their employer caused a collision. This could include other truck drivers or commercial vehicle operators that failed to act in a safe manner and caused a crash.
Steps to Take After Cortland County Truck Accidents
Poor weather conditions remain a leading cause of preventable car accidents in the United States. According to the U.S. Department of Transportation, “On average, over 3,800 people are killed and over 268,000 people are injured in weather-related crashes each year. (Source: Five-year averages from 2019 to 2023 analyzed by Athey Creek Consultants, based on NHTSA data).” Several steps should be taken after any accident.
- Medical Treatment: Victims should seek medical treatment as early as possible. The injuries associated with a serious collision will not always be immediately obvious.
- Police Report: The police report associated with the accident should be carefully reviewed. This report represents an officer’s initial impression of what happened. But these reports can also contain errors.
- Evidence Preservation: All of the evidence associated with the accident should be collected and preserved. Photos of the accident site should be taken. When possible, surveillance footage should also be sought.
- Legal Review: Any person injured in a Cortland County truck accident should seek the guidance of an experienced truck accident lawyer. An attorney can examine the unique facts of your case free of cost and let you know how much compensation you may be entitled to.
The vast majority of truck accidents are preventable. They tend to involve situations where drivers are traveling too fast for the prevailing conditions or are distracted. Unfortunately, business owners and their insurance providers will virtually never accept responsibility if one of their drivers causes an accident. This is why it is so important for these incidents to be properly investigated by an outside party. Any person injured in a truck accident may be able to pursue some measure of justice and accountability through a personal injury claim.
