EAST FARMINGDALE, NEW YORK (January 15, 2026) – A worker identified as Elmer Rios was injured in a Farmingdale industrial accident at L&S Packing Company.

Suffolk County officials are saying that the accident took place on Wednesday. Elmer Rios was cleaning some type of food dicing machine.

At some point during that process, the worker sustained a major laceration to his hand and ended up losing three fingertips. Paramedics were called to the scene of the accident to help the victim.

Elmer Rios was transported to Good Samaritan Hospital Medical Center in West Islip to receive treatment. A full investigation by the Occupational Safety and Health Administration (OSHA) remains ongoing at this time.

Liability for East Farmingdale Industrial Accidents

Every employer in the United States has a legal obligation to maintain a safe working environment for their employees. According to 29 U.S.C. § 654(a)(1), “each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.” Employers should take several actions to prevent workers from being injured by industrial equipment.

  • Personal Protective Equipment: Workers should be provided with all of the personal protective equipment (PPE) that they will need to remain safe in their professions.
  • Lockout/Tagout Procedures: Employers should implement formal Lockout/Tagout procedures to prevent machines from being accidentally turned on. All workers should be trained in these procedures.
  • Machine Guarding: Employers should install physical guards on certain machines to block access to blades that could cause workers to be seriously injured.

When a worker is injured in New York, they will typically have recourse through the workers’ compensation system. They may also be able to hold employers directly liable for an accident through the state’s labor laws. According to New York Labor Law § 200, worksites must be maintained in a reasonably safe condition. To that end, “All machinery, equipment, and devices in such places shall be so placed, operated, guarded, and lighted as to provide reasonable and adequate protection to all such persons.” When machinery at a business is in an unsafe condition, this could form the basis of a civil claim.

Steps to Take After New York Industrial Accidents

Many workers are injured in accidents with machinery every year in the United States. According to OSHA, “Employee exposure to unguarded or inadequately guarded machines is prevalent in many workplaces. Consequently, workers who operate and maintain machinery suffer approximately 18,000 amputations, lacerations, crushing injuries, abrasions, and over 800 deaths per year.” Certain steps should be taken after any workplace accidents.

  • Medical Treatment: Victims should seek medical treatment as early as possible. Many of the injuries associated with an industrial accident will not be immediately obvious.
  • Evidence Preservation: All of the evidence associated with the accident should be carefully preserved. This will include photos of the accident site and safety records of the machinery involved.
  • OSHA Report: Any reports from OSHA or other regulatory bodies related to the accident should be carefully reviewed. These reports can shed light on what went wrong.
  • Legal Review: Workers that are injured in their jobs should seek the legal guidance of experienced personal injury attorneys. Attorneys can review the unique facts of any case and take steps to identify all liable parties.

The vast majority of machine accidents are preventable. They tend to involve situations where workers do not receive adequate training. Another major problem is that dangerous pieces of machinery do not have sufficient guards to prevent injuries. It is important for victims of these accidents to understand that they do have legal options. They are able to pursue some measure of accountability through a civil claim.
